PLEASE READ CAREFULLY AND ACCEPT THE FOLLOWING TERMS OF USE AND SALE BEFORE USING BAUER HOCKEY ("BAUER") DIGITAL TOOLS WHICH INCLUDE THE BAUER HOCKEY WEBSITE ("Website") AND BAUER ANDROID AND IOS MOBILE APPLICATIONS ("Mobile Applications"), AND BEFORE PURCHASING PRODUCTS OR USING ANY SERVICES ON THESE DIGITAL TOOLS.

PRIVACY POLICY

The data processing activities carried out for your use of the Bauer Website or Bauer Mobile Applications are described in the BAUER Privacy Policy.

INTELLECTUAL PROPERTY

All intellectual property on the Bauer Website and Bauer Mobile Applications (except for any user generated content) is owned or licensed by BAUER and/or its affiliates. All rights to the intellectual property on this Website are reserved. Any use of the trademarks or other intellectual property on this Website or used on Bauer Mobile Applications without express written authorization is strictly prohibited. You may display and, subject to any expressly stated restrictions or limitations relating to specific material, download or print portions of the material from the different areas of the Website and Mobile Applications solely for your own non-commercial use or to purchase BAUER products. Any other use, including but not limited to the reproduction, distribution, display or transmission of the content used on the Bauer Website or within the Bauer Mobile Applications is strictly prohibited, unless authorized in writing by BAUER. You further agree not to change or delete any proprietary notices from materials downloaded from the Website.

By simply using the Bauer Website and Bauer Mobile Applications, you agree not to use, or assist any third party to use, any robot, bot, scraper, site search/retrieval application, proxy or other manual or automatic device, method, system or process to access, retrieve, index or “data mine” the content used on the Bauer Website or within the Bauer Mobile Applications. 

USER CONTENT

The Website and Mobile Applications may allow you and other users to provide content, including ratings, reviews, comments, images, videos or any other type of media (“User Content”). You acknowledge that you are solely responsible for your User Content, your User Content is not confidential , and others may access or use your User Content.

You must only submit User Content if: you are the sole author and owner of all rights to the User Content or have all necessary permissions; your submission is in accordance with these Terms and any other guidance we provide; and your submission complies with all applicable laws and regulations. We retain sole discretion to remove any User Content that is in breach of these Terms or applicable laws.

You will not submit User Content that:

  • may cause injury to any person or entity;
  • is false or misleading;
  • infringes any third party’s copyright, patent, trademark, trade secret or other proprietary rights;
  • violates anyone’s rights to privacy or publicity;
  • violates any law or regulation;
  • includes content or links to content that could be considered defamatory, libelous, knowingly false, fraudulent, indecent, violent, obscene, profane, hateful, racially or religiously biased, threatening, or harassing;
  • is inconsistent with the safe and proper use of any BAUER product or service;
  • or promotes commercial activities and/or sales without our prior written consent.

You should not submit User Content that includes personally identifiable information about yourself or any other person, unless the services specifically request that you provide such information.

Other than your personal information (for example, your full name, address, and email address), you grant us and our authorized third-party retailers and affiliates a worldwide, for a maximum period of 70 years after the publication of the User Content, royalty-free, transferable license to your User Content, including any username or social media handle you used when submitting the User Content. This includes the right to use, copy, adapt, publish, translate, create derivative works from  your User Content, in connection with the marketing and the promotion of BAUER, products and/or services, on the following media: print and digital media such as social media platform pages and websites of BAUER and of its affiliates, and through all means of distribution (including, but not limited to, Internet, printed materials, emails, newsletters, press).

It is agreed that BAUER may maintain any User Content on its social network pages beyond the aforementioned term, for the sole purposes of archiving, provided that the said User Content is not re-posted.

You acknowledge that all your User Content may be used and shared by us with other users. Subject to mandatory provisions governing copyright, if you provide us with any ideas, proposals, suggestions or other materials relating to the Website, Mobile Applications or any other BAUER products or services, BAUER may make your feedback public and use the feedback in any manner for any purpose without restriction or compensation to you. You guarantee that the feedback you submit is not confidential information nor protected by intellectual property rights.

We welcome you to share your User Content and information about our products and services, through social media. You grant us the right to reproduce and publish your social media postings related to the Website or Mobile Applications and to use the username or social media handle that you used when sharing the content under the above terms and conditions. You are responsible for complying with the terms and conditions of the social media platforms you use.

YOU ARE SOLELY RESPONSIBLE FOR YOUR USER CONTENT, OTHERS’ USER CONTENT THAT YOU CHOOSE TO USE, AND ANY CONSEQUENCES THEREOF.

PROHIBITED USE

Harassment in any manner or form on the Bauer Website or Bauer Mobile Applications, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a BAUER or other licensed employee, host, or representative, as well as other members or visitors on the Website or within the Mobile Applications is prohibited. You may not upload to, distribute, or otherwise publish through the Website or Mobile Applications any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law or regulation. You may not upload commercial content on the Website or on the Mobile Applications or use the Website or Mobile Applications to solicit others to join or become members of any other commercial online service or other organization. Any use of the Bauer Website or Bauer Mobile Applications for an illegal or objectionable purpose is strictly prohibited. You agree that you will not use the Bauer Website or Bauer Mobile Applications to engage in any activity that could be deemed illegal, harmful to others, or give rise to civil or criminal liability. BAUER reserves the right to monitor transmissions and investigate any alleged prohibited use of the Bauer Website and Bauer Mobile Applications and to disclose any and all information relating to such prohibited use.

PARTICIPATION DISCLAIMER

BAUER does not and cannot review all communications and materials posted to or created by users accessing the Website or Mobile Applications, and is not in any manner responsible for the content of these communications and materials, except in the cases where BAUER has a legal obligation to block or remove these communications and materials.  BAUER reserves the right to block or remove at any time communications or materials that it determines to be contrary to the applicable laws and regulations and/or to the Terms (including, but not limited, to the Third Party Content and Prohibited Use sections) .

THIRD PARTY CONTENT

While we try to provide the Bauer Website and Mobile Applications error-free, we do not guarantee that the third-party content posted on the Website or Mobile Applications is complete, current, or error-free. If we discover errors, we will make reasonable efforts to correct them.

THIRD PARTY LINKS

In an attempt to provide increased value to our visitors, BAUER may link to sites operated by third parties. However, even if the third party is affiliated with BAUER, BAUER has no control over these linked sites, all of which have separate privacy and data collection practices, independent of BAUER. You should carefully review the privacy policies and terms of use posted on these third-party sites. BAUER is not responsible for the content, policies, or activities of these third parties. These linked sites are for your convenience only and therefore you access them at your own risk. Nonetheless, BAUER seeks to protect the integrity of its Website and the links placed upon it and therefore requests any feedback on not only its own Website, but also for linked sites (including if a specific link does not work).

CREATING AND USING AN ACCOUNT

You do not need to create an account to use the Website and the Mobile Applications and place orders for products.

However, you can create a personal account (the "BAUER Account") for free by signing up on our Website or our Mobile Applications:

  • Provide the following information:
    • Name and surname
    • Billing address
    • Delivery address
    • E-mail address
  • By creating a BAUER Account, you will share some personal data. For details on data collection, usage, and your rights, see our Privacy Policy here.
  • Accept these Terms.;
  • After creating your BAUER Account, you will receive an activation link via email. Click the link to be redirected to the login page.
  • You can now use your BAUER Account to place orders.

With a BAUER Account, you get additional features such as: the ability to add and manage addresses, save payment details for faster checkout experience, view past orders and easier shipment tracking.

You can only create one BAUER Account per person. If we suspect multiple accounts, we may terminate them immediately. Your BAUER Account is personal. Do not share your password or grant access to others.

You can close your BAUER Account at any time, free of charge, by emailing us using the contact information provided in these Terms. It may take up to 180 days to process your request, during which you can still use your account.

When using your BAUER Account, comply with these Terms. We may terminate or suspend your account if you: (a) Use it for fraudulent purposes; (b) Breach these Terms or applicable laws; (c) Infringe third-party rights (e.g., reusing protected materials from the Website/Mobile Applications); (d) Harm our commercial interests unjustifiably (e.g., posting baseless negative reviews or using fake delivery addresses).

We will notify you before terminating or suspending your BAUER Account and explain the reason, unless it involves a criminal violation or legal obligations that do not require prior notice. We will restore access if you provide compelling reasons that our action was unjustified.

PURCHASES

Product availability

We cannot guarantee availability of any particular product and sometimes an item may not be available. In that case, we will keep you informed on the Website or Mobile Applications. We reserve the right to discontinue selling any product at any time without notice to the extent permitted by applicable laws.

The products we offer for sale remain our property until you proceed to full payment. After payment is executed, all property rights on the products will be passed on to you.

Pricing

The prices of our products are indicated inclusive of taxes (VAT and any other applicable tax).

The prices of our products can be amended from time to time, but you will pay the price displayed on the Website or Mobile Applications for the products ordered at the time you confirm your order. If there has been an error on the prices displayed on the Website or Mobile Applications, we will reach out to you as soon as possible and you will have the right to cancel your order at no additional cost. Prices may differ from other promotional prices we or others make available online or other retailer prices in your area. In some cases, intermediate markdowns may have been taken.

The costs for delivery and dispatching the products will be displayed separately on the Website or Mobile Applications. You will be informed of these additional delivery and dispatching costs, if applicable, at the latest before you confirm your order.

Order conditions and process

You can order and purchase products on the Website or Mobile Applications if you are at least 18 years old and have a valid means of payment.

When you order one or several products on the Website or Mobile Applications, the following order process applies:

  • You click on the product you want to order and are redirected on the product's page;
  • You add the product to your "Bag" by clicking on the dedicated "Add to Bag" button;
  • You will be redirected to your order summary, containing the products that you've added to your Bag (type and quantity), the applicable delivery costs and the price (inclusive of all taxes). You will also have the possibility to enter discount code or gift card in the dedicated space. You will be requested to enter your delivery address, billing address (if different), and select your payment method.
  • Before finalising your order, you can check and correct any errors you may have made when entering your details.
  • If you want to finalize your order and then proceed to payment, click on "Pay Now". Once you click on this button, you will confirm that a valid contract is entered between you and us and you will automatically proceed to payment through the means of payment entered.
  • Shortly after that, you should also receive an e-mail confirming your order and summarizing your order details at the e-mail address referred in your order.
  • Once your items have been shipped, you will receive a shipping confirmation email with details of which items have been sent. Please note that if you order more than one item, it is possible that different items may arrive on different days depending on stock availability.

Places of delivery

These Terms apply to your orders for which your delivery address (or the recipient's delivery address) is located in one of the Member States of the European Union or the United Kingdom.

Delivery Restrictions: fi.bauer.com will only ship within Finland. Orders cannot ship to a PO Box or to a forwarding agent.

Please note that there may be delays in your order due to events which we cannot control (postal/carrier delays, weather conditions, logistics issues) etc. In any event, we will inform you of any unexpected delay in your order. If there is any issue with a delivery, we will be in touch with you using the contact information referred in your order. You can also reach out to us using the contact information provided in these Terms.

Payment

Payment for all products must be made by credit or debit card. We accept payment with Visa, Mastercard, Maestro, AmEx, UnionPay, ApplePay, and Google Pay..

Your payments for all orders placed on the Website or Mobile Applications are technically handled by a third party, Shopify Payments Gateway.

Your withdrawal rights

Your rights. You have the right to withdraw, that is, cancel your order, within 14 days starting from the working date following your receipt of the products (or if applicable, the recipient's receipt of the products), provided that you have not used the products, without giving any reason and without any additional costs (except the costs for sending back the products as explained below), and to obtain a refund for the cancelled order.

What you need to do. In order to exercise your withdrawal right, you must:

  • Inform us of your decision to withdraw from your order by an unequivocal statement (e.g. a letter sent by post or e-mail). You may also use the model withdrawal form available at the end of these Terms, but this is not mandatory; and
  • You can contact us by phone at +35827237111or send us your completed withdrawal form or statement by e-mail at the following e-mail address: web-eu@bauer.com.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period of 14 days has expired. After completing one of these steps, and if you have already received the products, you will be requested to return the products to us following the steps described below.

How to return the products. In order to return the products to us and obtain a refund, you must follows these steps:

  • Pack the products and return only unused products, if possible in their original packaging and complete with original labels, accessories, instructions for use and warranty notices;
  • You must indicate the following address on your return package, as well as your details:

You are free to choose the courier or delivery service you will use for returning the products. You will have to pay any delivery fee incurred for returning the products and it will not be refunded by us.

  • The products should be sent back to us within a 14 days period following the day which you have informed us of your decision to exercise your withdrawal right.
  • We will inform you shortly if there are any issues regarding your returned products. You can also always contact us using the contact information provided in these Terms.

Refund. We will refund the price you paid for the order within 14 days from the earliest of one of these dates: the date we have received your products or the date on which you provided us with the proof that the products were shipped.

We will refund the price you paid for the order using the same means of payment you used for the order, unless you have indicated another means of refund to us.

If you have paid a delivery fee for your order, we will refund the cost of a standard delivery to your country.

If you have chosen for a faster or more expensive means of delivery, the costs exceeding those of a standard delivery will remain at your charge. For example, if the standard delivery in your country costs €4 but you opted for an express delivery for €8, then we will refund you €4. However, if the products delivered were incorrect or damaged, and you benefit from your legal guarantee rights as explained below, you will be entitled to a full refund of your delivery fee, regardless of the delivery option chosen.

Damaged products. You are only liable for any diminished value of the products resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the products. We will have the right to withhold a part of the refund as compensation if the products are damaged when returned.

Exceptions. You do not have a right of withdrawal when the products are made to your specifications or clearly personalised.

Your legal guarantee regarding conformity of the products

You are always entitled to exercise your rights in relation to the conformity guarantee on the products as set out under the EU Directive 2019/771 of 20 May 2019 on certain aspects concerning contracts for the sale of goods, and the local implementing legislation applicable to you. This legal guarantee applies to any lack of conformity of the products arising within 2 years from their delivery.

Please note that under relevant local legislation, you may even be entitled to a longer guarantee, as well as a guarantee covering hidden defects relating to the products.

Nothing in these Terms is intended to reduce or limit your rights under this legal guarantee.

DISCLAIMERS AND LIMITATION OF LIABILITY

BAUER MAKES NO PROMISES WITH RESPECT TO ANY THIRD-PARTY WEBSITE, THIRD-PARTY PRODUCT, OR THIRD-PARTY SERVICE LISTED ON OR ACCESSIBLE TO YOU THROUGH THE WEBSITE OR MOBILE APPLICATIONS.

PROVIDED THAT BAUER HAS ACTED WITH PROFESSIONAL DILIGENCE, BAUER DOES NOT TAKE RESPONSIBILITY FOR LOSS OR DAMAGE CAUSED BY BAUER, UNLESS IT IS:

  • CAUSED BY BAUER’S BREACH OF THESE TERMS OR LEGAL OBLIGATIONS; OR
  • REASONABLY FORESEEABLE AT THE TIME OF ENTERING INTO THESE TERMS (I.E. EITHER IT IS OBVIOUS THAT IT WILL HAPPEN OR, AT THE TIME OF THIS CONTRACT, IT IS KNOWN THAT IT MIGHT HAPPEN).

BAUER DOES NOT TAKE RESPONSIBILITY FOR LOSS OR DAMAGE IF IT IS CAUSED BY A FORCE MAJEURE EVENT, OR BY THE UNFORESEEABLE AND INSURMOUNTABLE ACT OF A THIRD PARTY TO THE CONTRACT, OR BY YOURSELF.

NOTHING IN THESE TERMS AFFECTS ANY STATUTORY RIGHTS THAT YOU CANNOT CONTRACTUALLY AGREE TO ALTER OR GIVE UP, OR ARE LEGALLY ALWAYS ENTITLED TO, FOR EXAMPLE, BECAUSE YOU ARE A CONSUMER. BAUER DOES NOT EXCLUDE OR LIMIT IN ANY WAY ITS LIABILITY TO YOU WHERE IT WOULD BE UNLAWFUL TO DO SO, IN PARTICULAR IN CASE OF DEATH, PERSONAL INJURY, FRAUD, FRAUDULENT MISREPRESENTATION, OR GROSS NEGLIGENCE. YOU WILL ALWAYS HAVE THE FULL PROTECTIONS OF THE LAWS THAT APPLY TO YOU. BAUER HAS A STATUTORY LIABILITY FOR PRODUCT DEFECTS.

TERM AND TERMINATION

By ticking the relevant box(es) during the registration and/or purchasing process, you agree to these Terms.

These Terms or any part thereof may be terminated by BAUER, if there is a valid reason to do so and subject to giving you reasonable advance notice.

BAUER may also terminate your account, delete your profile (or any of your user generated content), or restrict your use of all or any part of the Website or Mobile Application, if there is a valid reason to do so and subject to giving you reasonable advance notice. 

A valid reason  includes: (i) to comply with legal or regulatory requirements, such as mandatory laws or court orders; (ii) when the user breaches these Terms or the law; (iii) if BAUER reorganizes its business, including mergers.

If we decide to terminate your account, delete your profile (or any of your user generated content), or restrict your use of all or any part of the Website or Mobile Application we will provide you with 30 days’ notice.

The provisions relating to Intellectual Property, NHL Trademarks, Participation Disclaimer, Disclaimers and Limitation of Liability, Severability and Miscellaneous, shall survive any termination.

GOVERNING LAW AND DISPUTE RESOLUTION

These Terms, as well as any dispute in relation to the conclusion, the interpretation, the execution or termination of a contract between you and us are solely governed by and construed in accordance with the laws of the territory identified in the table below.

Should any dispute arise between you and us, we will always try to find acceptable solutions with you. All disputes that cannot be settled amicably may be brought before the courts of your territory of residence.

If a dispute concerning a sales contract cannot be resolved through negotiation between the parties, the consumer can submit the matter to the Consumer Disputes Board (www.kuluttajariita.fi/en) for resolution.

Before taking the matter to the Consumer Disputes Board, the consumer should contact the Local Register Offices’ Consumer Advisory Service (www.kuluttajaneuvonta.fi).

COMMUNICATIONS

When you use the Bauer Website or Bauer Mobile Applications, you may be given the opportunity to consent to receive communications from us through email, text, and/or mobile push notifications. Standard text and calling rates will apply.

You agree that texts, calls or prerecorded messages may be generated by automatic telephone dialing systems. You can then opt out of promotional communications by following the “Unsubscribe” directions for emails, through the settings of the Bauer Website or Bauer Mobile Applications, or, if via text message, by responding STOP.

YOU ACKNOWLEDGE THAT YOU ARE NOT REQUIRED TO CONSENT TO RECEIVE PROMOTIONAL TEXTS OR CALLS AS A CONDITION OF USING THE BAUER WEBSITE OR BAUER MOBILE APPLICATIONS.

CHANGES TO THESE TERMS

BAUER may make changes to these Terms from time to time. If we do, we will consider your reasonable interests before doing so. We will also give you reasonable advance notice, in a transparent manner, of significant changes which will impact you and the date that they will come into force. The changes will only apply to our relationship going forward. Where we need to make urgent changes for security, safety, legal or regulatory requirements, we may not be able to provide you with advance notice, but we will let you know as soon as we are able to. If you do not agree to the changes to the Terms, you will have to stop using the Website or Mobile Application.

SEVERABILITY

If any provision in these Terms of Use is held invalid, the remainder of these terms shall continue to be enforceable. If any provision in these Terms of Use is deemed unlawful, void or unenforceable, then that provision is deemed severable from these terms and the remaining provisions are still valid and enforceable.

Bauer’s collection and use of your email address is subject to the BAUER Privacy Policy. 

Depending on your local country and subject to specific conditions, if you make a purchase on the Bauer Website or Bauer Mobile Applications you will be opted in to receive promotional email communications from Bauer (“Email Communications”) for similar products and services, subject to a prior information and right to opt-out to such Email Communications at the time of purchase. You may opt out of receiving Email Communications from Bauer at any time by clicking the “unsubscribe” link in the Email Communication.

Contests, Promotions, and Sweepstakes

Contests, sweepstakes and other similar promotions that you enter on the Bauer Website or Bauer Mobile Applications or in connection with Bauer products or services (“Bauer Promotions”) may be subject to official rules and/or conditions that are supplemental to these Terms, and which may provide details governing the Bauer Promotion such as eligibility requirements, entry instructions, deadlines, prize information and restrictions.

If you wish to participate in any Bauer Promotion, please first review and then accept the applicable official rules and/or conditions. If a Bauer Promotion’s official rules and/or conditions conflict with these Terms, the provisions contained in the official rules and/or conditions govern and control the Bauer Promotion. Your entry to a Bauer Promotion constitutes User Content (as defined above) and is subject to all provisions of these Terms that govern your submission and our use of your User Content.

IMMATERIAALIOIKEUDET

Kaikki Bauerin Verkkosivuston ja Bauerin Mobiilisovellusten immateriaalioikeudet (lukuun ottamatta käyttäjän tuottamaa sisältöä) ovat BAUERin ja/tai sen tytäryhtiöiden omistuksessa tai lisensoimia. KÄYTTÄJÄN SISÄLTÖ

Verkkosivusto ja Mobiilisovellukset voivat antaa sinulle ja muille käyttäjille mahdollisuuden tarjota sisältöä, mukaan lukien luokituksia, arvosteluja, kommentteja, kuvia, videoita tai muunlaista mediasisältöä ("Käyttäjäsisältö"). Hyväksyt, että olet yksin vastuussa Käyttäjäsisällöstäsi, Käyttäjäsisältösi ei ole luottamuksellista ja että muut voivat päästä käsiksi Käyttäjäsisältöösi tai käyttää sitä.

Saat lähettää Käyttäjäsisältöä vain, jos: olet Käyttäjäsisällön ainoa tekijä ja kaikkien oikeuksien omistaja tai sinulla on kaikki tarvittavat luvat; lähetys on näiden Ehtojen ja muiden antamiemme ohjeiden mukainen; ja lähetys on kaikkien sovellettavien lakien ja määräysten mukainen. Käyttäjä ei saa lähettää Käyttäjäsisältöä, joka sisältää henkilökohtaisesti tunnistettavia tietoja itsestään tai muista henkilöistä, ellei -palveluissa nimenomaisesti pyydetä antamaan tällaisia tietoja.

Henkilökohtaisia tietojasi (esimerkiksi koko nimeäsi, osoitettasi ja sähköpostiosoitettasi) lukuun ottamatta myönnät meille ja valtuutetuille kolmannen osapuolen jälleenmyyjillemme ja tytäryhtiöillemme maailmanlaajuisen, enintään 70 vuoden ajan käyttäjäsisällön julkaisemisesta voimassa olevan, rojaltivapaan ja siirrettävissä olevan lisenssin Käyttäjäsisältöösi, mukaan lukien mikä tahansa käyttäjätunnus tai sosiaalisen median tunniste, jota käytit Käyttäjäsisältöä lähettäessäsi. Annat meille oikeuden jäljentää ja julkaista Verkkosivustoon tai Mobiilisovelluksiin liittyviä sosiaalisen median julkaisujasi ja käyttää käyttäjätunnusta tai sosiaalisen median tunnusta, jota käytit sisältöä jakaessasi edellä mainittujen ehtojen mukaisesti. KIELLETTY KÄYTTÖ

Bauerin verkkosivustolla tai Bauerin mobiilisovelluksissa tapahtuva häirintä millään tavalla tai missään muodossa, mukaan lukien sähköpostitse, chatissa tai käyttämällä säädytöntä tai loukkaavaa kieltä, on ehdottomasti kielletty. Muiden henkilöiden, mukaan lukien BAUERin tai muun luvallisen työntekijän, isännän tai edustajan, sekä muiden jäsenten tai vierailijoiden esittäminen Verkkosivustolla tai Mobiilisovelluksissa on kielletty. Verkkosivustolle tai Mobiilisovelluksiin ei saa ladata, jakaa tai muuten julkaista Verkkosivuston tai Mobiilisovellusten kautta mitään sisältöä, joka on herjaavaa, kunniaa loukkaavaa, säädytöntä, uhkaavaa, yksityisyyttä tai julkisuusoikeuksia loukkaavaa, loukkaavaa, laitonta tai muutoin paheksuttavaa, joka voi muodostaa tai rohkaista rikokseen tai loukata jonkun osapuolen oikeuksia, tai joka voi muutoin johtaa vastuuseen tai rikkoa mitä tahansa lakia tai määräystä. Bauerin Verkkosivuston tai Bauerin Mobiilisovellusten käyttö laittomaan tai sopimattomaan tarkoitukseen on ehdottomasti kielletty. Sitoudut siihen, että et käytä Bauerin Verkkosivustoa tai Bauerin Mobiilisovelluksia mihinkään sellaiseen toimintaan, jota voidaan pitää laittomana, muille haitallisena tai joka voi johtaa siviili- tai rikosoikeudelliseen vastuuseen. BAUER pidättää oikeuden valvoa lähetyksiä ja tutkia Bauerin Verkkosivuston ja Bauerin Mobiilisovellusten väitettyä kiellettyä käyttöä sekä julkistaa kaikki tällaiseen kiellettyyn käyttöön liittyvät tiedot.

OSALLISTUMISVASTUUVAPAUSLAUSEKE

BAUER ei tarkista eikä voi tarkistaa kaikkia viestejä ja materiaaleja, jotka on lähetetty tai luotu käyttäjien toimesta, jotka käyttävät Verkkosivustoa tai Mobiilisovelluksia, eikä se ole millään tavalla vastuussa näiden viestien ja materiaalien sisällöstä, paitsi tapauksissa, joissa BAUERilla on oikeudellinen velvollisuus estää tai poistaa nämä viestit ja materiaalit.  BAUER pidättää oikeuden estää tai poistaa milloin tahansa viestinnän tai materiaalin, jonka se katsoo olevan sovellettavien lakien ja asetusten ja/tai Ehtojen vastaista (mukaan lukien, mutta ei rajoittuen, kappaleisiin kolmannen osapuolen sisältö ja kielletty käyttö).

KOLMANNEN OSAPUOLEN SISÄLTÖ

Vaikka pyrimme tarjoamaan Bauerin Verkkosivuston ja Mobiilisovellukset virheettöminä, emme takaa, että Verkkosivustolla tai Mobiilisovelluksissa oleva kolmannen osapuolen sisältö on täydellistä, ajantasaista tai virheetöntä. Jos havaitsemme virheitä, pyrimme kohtuullisesti korjaamaan ne.

KOLMANSIEN OSAPUOLTEN LINKIT

BAUER voi linkittää kolmansien osapuolten ylläpitämille sivustoille tarjotakseen kävijöillemme lisäarvoa. Kuitenkin vaikka kolmas osapuoli olisi sidoksissa BAUERiin, BAUERilla ei ole määräysvaltaa näihin linkitettyihin sivustoihin, joilla kaikilla on erilliset BAUERista riippumattomat yksityisyydensuojaa ja tiedonkeruuta koskevat käytännöt. Sinun ei tarvitse luoda tiliä käyttääksesi Verkkosivustoa ja Mobiilisovelluksia ja tehdäksesi tilauksia tuotteista

Voit kuitenkin luoda henkilökohtaisen tilin ("BAUER-tili") ilmaiseksi rekisteröitymällä Verkkosivustollamme tai Mobiilisovelluksissamme:

  • Anna seuraavat tiedot:
    • Etu- ja sukunimi
    • Laskutusosoite
    • Toimitusosoite
    • Sähköpostiosoite
  • Luodessasi BAUER-tilin jaat joitakin henkilötietoja. Yksityiskohtaiset tiedot tietojen keräämisestä, käytöstä ja oikeuksistasi löydät tietosuojaselosteestamme täältä.
  • Hyväksy nämä Ehdot.
  • Kun olet luonut BAUER-tilisi, saat aktivointilinkin sähköpostitse. Klikkaa linkkiä, niin sinut ohjataan kirjautumissivulle.
  • Voit nyt käyttää BAUER-tiliäsi tilausten tekemiseen.

BAUER-tilillä saat lisäominaisuuksia, kuten: mahdollisuuden lisätä ja hallita osoitteita, tallentaa maksutiedot nopeuttaaksesi kassakäyntiä, tarkastella aiempia tilauksia ja helpottaa lähetysten seurantaa.

Voit luoda vain yhden BAUER-tilin per henkilö. Jos epäilemme useita tilejä, voimme päättää ne välittömästi. BAUER-tilisi on henkilökohtainen. Älä jaa salasanaasi tai anna pääsyä muille.

Voit sulkea BAUER-tilisi milloin tahansa maksutta lähettämällä meille sähköpostia näissä Ehdoissa annettuihin yhteystietoihin. Pyyntösi käsittelyyn voi kulua jopa 180 päivää, jonka aikana voit edelleen käyttää tiliäsi.

Kun käytät BAUER-tiliäsi, noudata näitä Ehtoja. Voimme irtisanoa tilisi tai keskeyttää sen käytön, jos: (a) käytät sitä vilpillisiin tarkoituksiin; (b) rikot näitä Ehtoja tai sovellettavia lakeja; (c) loukkaat kolmannen osapuolen oikeuksia (esim. käytät uudelleen suojattua materiaalia Verkkosivustolta/Mobiilisovelluksista); (d) vahingoitat kaupallisia etujamme perusteettomasti (esim. perustelemattomien negatiivisten arvostelujen julkaiseminen tai väärennettyjen toimitusosoitteiden käyttäminen).

Ilmoitamme sinulle ennen BAUER-tilisi irtisanomista tai keskeyttämistä ja selitämme syyn, paitsi jos kyseessä on rikos tai lakisääteinen velvoite, joka ei edellytä ennakkoilmoitusta. Palautamme käyttöoikeuden, jos esität painavat syyt sille, että toimenpiteemme oli perusteeton.

HANKINNAT

Tuotteen saatavuus

Emme voi taata minkään tietyn tuotteen saatavuutta, ja joskus tuote ei välttämättä ole saatavilla. Tällaisessa tapauksessa pidämme sinut ajan tasalla Verkkosivustolla tai Mobiilisovelluksissa. Pidätämme oikeuden lopettaa minkä tahansa tuotteen myynnin milloin tahansa ilman ennakkoilmoitusta siinä määrin kuin se on sallittua soveltuvan lainsäädännön mukaan.

Myytäväksi tarjoamamme tuotteet pysyvät omistuksessamme, kunnes maksat ne kokonaan. Maksun suorittamisen jälkeen kaikki tuotteiden omistusoikeudet siirtyvät sinulle

Hinnoittelu

Tuotteidemme hinnat on ilmoitettu veroineen (arvonlisävero ja muut sovellettavat verot).

Tuotteidemme hintoja voidaan muuttaa aika ajoin, mutta maksat tilaamastasi tuotteesta sen hinnan, joka näkyy Verkkosivustolla tai Mobiilisovelluksissa silloin, kun vahvistat tilauksesi. Jos Verkkosivustolla tai Mobiilisovelluksissa näkyvässä hinnassa on virhe, otamme sinuun yhteyttä mahdollisimman pian, ja sinulla on oikeus peruuttaa tilauksesi ilman lisäkustannuksia. Hinnat voivat poiketa muista kampanjahinnoista, joita me tai muut tahot tarjoavat verkossa, tai muista jälleenmyyjien hinnoista alueellasi. Joissakin tapauksissa on saatettu tehdä välialennuksia.

Tuotteiden toimitus- ja lähetyskulut ilmoitetaan erikseen Verkkosivustolla tai Mobiilisovelluksissa. Sinulle ilmoitetaan näistä mahdollisista ylimääräisistä toimitus- ja lähetyskuluista viimeistään ennen tilauksen vahvistamista.

Tilausehdot ja -prosessi

Voit tilata ja ostaa tuotteita Verkkosivustolta tai Mobiilisovelluksista, jos olet vähintään 18-vuotias ja sinulla on voimassa oleva maksuväline.

Kun tilaat yhden tai useamman tuotteen Verkkosivustolta tai Mobiilisovelluksista, noudatetaan seuraavaa tilausprosessia:

  • Klikkaat tuotetta, jonka haluat tilata, ja sinut ohjataan tuotteen sivulle
  • Lisää tuote "Kassiin" klikkaamalla "Lisää Kassiin" -painiketta
  • Sinut ohjataan tilauksesi yhteenvetoon, jossa on Kassiin lisäämäsi tuotteet (tyyppi ja määrä), soveltuvat toimituskulut ja hinta (sisältäen kaikki verot). Toimitusrajoitukset: fi.bauer.com toimittaa vain Suomen sisällä. Tilauksia ei voi toimittaa postilokeroon tai huolitsijalle.

Huomioithan, että tilauksesi voi viivästyä sellaisten tapahtumien vuoksi, joihin emme voi vaikuttaa (postin/kuljettajan viivästykset, sääolosuhteet, logistiikkaongelmat) jne. Ilmoitamme sinulle joka tapauksessa kaikista tilauksesi odottamattomista viivästyksistä. Jos toimitukseen liittyy ongelmia, otamme sinuun yhteyttä tilauksessasi mainituilla yhteystiedoilla. Voit myös ottaa meihin yhteyttä näissä Ehdoissa annettujen yhteystietojen avulla.

Maksu

Kaikki tuotteet on maksettava luotto- tai pankkikortilla. Hyväksymme maksun seuraavilla tavoin: Visa, Mastercard, Maestro, AmEx, UnionPay, ApplePay ja Google Pay.

Verkkosivuston tai Mobiilisovellusten kautta tehtyjen tilausten maksut hoitaa teknisesti kolmas osapuoli, Shopify Payments Gateway.

Peruuttamisoikeutesi

Sinun oikeutesi. Sinulla on oikeus peruuttaa tilauksesi ilman mitään syytä ja ilman lisäkustannuksia (lukuun ottamatta tuotteiden palauttamisesta aiheutuvia kustannuksia, kuten jäljempänä selitetään) 14 päivän kuluessa siitä arkipäivästä alkaen, kun olet vastaanottanut tuotteet (tai tarvittaessa vastaanottaja on vastaanottanut tuotteet), edellyttäen, ettet ole käyttänyt tuotteita, ja saada korvaus peruutetusta tilauksesta.

Peruuttamiselle asetetun määräajan noudattamiseksi riittää, että lähetät peruuttamisoikeuden käyttämistä koskevan viestisi ennen 14 päivän peruuttamisajan päättymistä. Kun olet suorittanut jonkin näistä vaiheista ja jos olet jo vastaanottanut tuotteet, sinua pyydetään palauttamaan tuotteet meille jäljempänä kuvattujen vaiheiden mukaisesti.

Palautus. Palautamme tilauksesta maksamasi hinnan 14 päivän kuluessa siitä, kun jompikumpi näistä päivämääristä on aikaisempi: päivä, jolloin olemme vastaanottaneet tuotteet tai päivä, jolloin olet toimittanut meille tositteen siitä, että tuotteet on lähetetty

Palautamme tilauksesta maksamasi hinnan käyttäen samaa maksutapaa, jota käytit tilauksen tekemiseen, ellet ole ilmoittanut meille toista palautustapaa.

Jos olet maksanut tilauksestasi toimitusmaksun, hyvitämme vakiotoimituksen kustannukset kotimaahasi.

Jos olet valinnut nopeamman tai kalliimman toimitustavan, vakiotoimituksen kustannukset ylittävät kustannukset jäävät sinun maksettavaksesi. Jos esimerkiksi vakiotoimitus maksaa maassasi 4 euroa, mutta valitsit 8 euron pikatoimituksen, palautamme sinulle 4 euroa. Jos toimitetut tuotteet olivat virheellisiä tai vahingoittuneita ja sinulla on jäljempänä selostetut lailliset takuuoikeutesi, sinulla on oikeus saada toimitusmaksusi kokonaisuudessaan takaisin riippumatta valitusta toimitustavasta.

Vaurioituneet tuotteet. Olet vastuussa ainoastaan tuotteiden arvon alenemisesta, joka johtuu muusta kuin tuotteiden luonteen, ominaisuuksien ja toiminnan määrittämiseksi tarvittavasta käsittelystä. Meillä on oikeus pidättää osa hyvityksestä korvauksena, jos tuotteet ovat vahingoittuneet palautettaessa.

Poikkeukset. Sinulla ei ole peruuttamisoikeutta, kun tuotteet on valmistettu sinun vaatimustesi mukaan tai ne on selvästi yksilöityjä.

Lakisääteinen takuu tuotteiden vaatimustenmukaisuudesta

Sinulla on aina oikeus käyttää tuotteiden vaatimustenmukaisuustakuuseen liittyviä oikeuksiasi, jotka on vahvistettu tietyistä tavarakauppaa koskeviin sopimuksiin liittyvistä seikoista 20. toukokuuta 2019 annetussa EU:n direktiivissä 2019/771 ja sinua koskevassa paikallisessa täytäntöönpanolainsäädännössä. Tämä lakisääteinen takuu koskee tuotteiden vaatimustenmukaisuuden puutteita, jotka ilmenevät 2 vuoden kuluessa niiden toimittamisesta.

Huomaa, että paikallisen lainsäädännön mukaan sinulla voi olla oikeus pidempäänkin takuuseen sekä takuuseen, joka kattaa tuotteisiin liittyvät piilevät viat.

Mikään näissä Ehdoissa ei ole tarkoitettu vähentämään tai rajoittamaan tämän lakisääteisen takuun mukaisia oikeuksiasi.

BAUER EI ANNA MITÄÄN LUPAUKSIA MISTÄÄN KOLMANNEN OSAPUOLEN VERKKOSIVUSTOSTA, KOLMANNEN OSAPUOLEN TUOTTEESTA TAI KOLMANNEN OSAPUOLEN PALVELUSTA, JOKA ON LUETELTU VERKKOSIVUSTOLLA TAI MOBIILISOVELLUKSISSA TAI JOHON PÄÄSET VERKKOSIVUSTON TAI MOBIILISOVELLUSTEN KAUTTA.

EDELLYTTÄEN, ETTÄ BAUER ON TOIMINUT AMMATTITAITOISEN HUOLELLISESTI, BAUER EI OTA VASTUUTA BAUERIN AIHEUTTAMISTA MENETYKSISTÄ TAI VAHINGOISTA, ELLEIVÄT NE:

  • JOHDU SIITÄ, ETTÄ BAUER RIKKOO NÄITÄ EHTOJA TAI LAKISÄÄTEISIÄ VELVOITTEITA; TAI
  • OLE KOHTUUDELLA ENNAKOITAVISSA NÄIDEN EHTOJEN SOLMIMISHETKELLÄ (ELI JOKO ON ILMEISTÄ, ETTÄ NÄIN TAPAHTUU, TAI TÄMÄN SOPIMUKSEN SOLMIMISHETKELLÄ TIEDETÄÄN, ETTÄ NÄIN SAATTAA TAPAHTUA).

BAUER EI OTA VASTUUTA MENETYKSISTÄ TAI VAHINGOISTA, JOS NE JOHTUVAT YLIVOIMAISESTA ESTEESTÄ, KOLMANNEN OSAPUOLEN ENNAKOIMATTOMASTA JA YLITSEPÄÄSEMÄTTÖMÄSTÄ TEOSTA TAI SINUN ITSESI AIHEUTETTAMASTA VAHINGOSTA.

MIKÄÄN NÄISSÄ EHDOISSA EI VAIKUTA MIHINKÄÄN LAKISÄÄTEISIIN OIKEUKSIIN, JOITA ET VOI SOPIMUKSIN SUOSTUA MUUTTAMAAN TAI JOISTA ET VOI LUOPUA TAI JOIHIN SINULLA ON LAILLISESTI AINA OIKEUS, ESIMERKIKSI SIKSI, ETTÄ OLET KULUTTAJA. BAUER EI SULJE POIS TAI RAJOITA MILLÄÄN TAVALLA VASTUUTAAN SINUA KOHTAAN, JOS SE OLISI LAINVASTAISTA, ERITYISESTI KUOLEMAN, HENKILÖVAHINGON, PETOKSEN, VILPILLISEN HARHAANJOHTAMISEN TAI TÖRKEÄN HUOLIMATTOMUUDEN TAPAUKSESSA. SINULLA ON AINA TÄYSI SUOJA SINUA KOSKEVIEN LAKIEN MUKAISESTI. BAUERILLA ON LAKISÄÄTEINEN VASTUU TUOTEVIRHEISTÄ.

VOIMASSAOLOAIKA JA IRTISANOMINEN

Hyväksyt nämä Ehdot merkitsemällä rastin asiaankuuluvaan ruutuun (ruutuihin) rekisteröinti- ja/tai ostoprosessin aikana

BAUER voi irtisanoa nämä Ehdot tai minkä tahansa osan niistä, jos siihen on pätevä syy ja siitä on annettu sinulle kohtuullinen ennakkoilmoitus.

BAUER voi myös irtisanoa tilisi, poistaa profiilisi ( tai minkä tahansa käyttäjän tuottaman sisällön), tai rajoittaa Verkkosivuston tai Mobiilisovelluksen kaikkien tai joidenkin osien käyttöä, jos siihen on pätevä syy ja jos siitä ilmoitetaan sinulle kohtuullisesti etukäteen.

Perusteltu syy sisältää: (i) lakisääteisten tai sääntelyvaatimusten, kuten pakottavien lakien tai oikeuden päätösten noudattaminen; (ii) jos käyttäjä rikkoo näitä Ehtoja tai lakia; (iii) jos BAUER organisoi liiketoimintaansa uudelleen, mukaan lukien fuusiot.

Jos päätämme lopettaa tilisi, poistaa profiilisi (tai minkä tahansa käyttäjän tuottaman sisällön) tai rajoittaa Verkkosivuston tai Mobiilisovelluksen käyttöä kokonaan tai osittain, ilmoitamme siitä sinulle 30 päivää etukäteen.Immateriaalioikeuksiin, NHL:n tavaramerkkeihin, osallistumislausekkeisiin, vastuuvapauslausekkeisiin ja vastuunrajoituksiin, ehtojen erotettavuuteen ja muihin ehtoihin liittyvät sopimuskohdat jäävät voimaan irtisanomisen jälkeen.

SOVELLETTAVA LAKI JA RIITOJENRATKAISU

Näihin Ehtoihin sekä kaikkiin riitoihin, jotka liittyvät sinun ja meidän välisen sopimuksen tekemiseen, tulkintaan, täytäntöönpanoon tai irtisanomiseen, sovelletaan yksinomaan alla olevassa taulukossa mainitun alueen lakeja ja niitä tulkitaan niiden mukaisesti.

Jos sinun ja meidän välillemme syntyy riitoja, pyrimme aina löytämään kanssasi hyväksyttävän ratkaisun. Kaikki riidat, joita ei voida ratkaista sovinnollisesti, voidaan viedä asuinpaikkasi tuomioistuimeen.

Jos myyntisopimusta koskevaa riitaa ei saada ratkaistua osapuolten välisillä neuvotteluilla, kuluttaja voi saattaa asian kuluttajariitalautakunnan ratkaistavaksi (www.kuluttajariita.fi/en).

Ennen asian viemistä kuluttajariitalautakuntaan kuluttajan on otettava yhteyttä maistraattien kuluttajaneuvontaan (www.kuluttajaneuvonta.fi).

VIESTINTÄ

Kun käytät Bauerin Verkkosivustoa tai Bauerin Mobiilisovelluksia, sinulle saatetaan antaa mahdollisuus antaa suostumuksesi saada meiltä viestintää sähköpostitse, tekstiviestillä ja/tai mobiilipush-ilmoituksilla. Tällöin sovelletaan tavanomaisia tekstiviesti- ja puheluhintoja.

Hyväksyt sen, että automaattiset puhelinvalintajärjestelmät voivat tuottaa tekstejä, puheluita tai ennalta nauhoitettuja viestejä. NÄIHIN EHTOIHIN TEHTÄVÄT MUUTOKSET

BAUER voi aika ajoin tehdä muutoksia näihin Ehtoihin. Jos teemme niin, otamme huomioon kohtuulliset etusi ennen kuin teemme niin. Ilmoitamme sinulle myös kohtuullisen ajoissa ja avoimesti merkittävistä muutoksista, jotka vaikuttavat sinuun, sekä niiden voimaantulopäivästä. Muutokset koskevat vain tulevaa suhdettamme. Jos meidän on tehtävä kiireellisiä muutoksia turvallisuuden tai lakisääteisten tai lainsäädännöllisten vaatimusten vuoksi, emme välttämättä pysty ilmoittamaan niistä etukäteen, mutta ilmoitamme sinulle niin pian kuin voimme. Jos et hyväksy Ehtojen muutoksia, sinun on lopetettava Verkkosivuston tai Mobiilisovelluksen käyttö.

EHTOJEN EROTETTAVUUS

Jos jokin näiden käyttöehtojen määräys katsotaan pätemättömäksi, muut ehdot ovat edelleen täytäntöönpanokelpoisia. Jos jokin näiden käyttöehtojen määräys katsotaan laittomaksi, mitättömäksi tai täytäntöönpanokelvottomaksi, kyseinen määräys katsotaan erotettavaksi näistä ehdoista ja muut määräykset ovat edelleen voimassa ja täytäntöönpanokelpoisia.

Jos haluat osallistua johonkin Bauerin kampanjaan, tutustu ensin sovellettaviin virallisiin sääntöihin ja/tai ehtoihin ja hyväksy ne. Jos Bauerin kampanjan viralliset säännöt ja/tai ehdot ovat ristiriidassa näiden Ehtojen kanssa, virallisten sääntöjen ja/tai ehtojen määräykset soveltuvat Bauerin kampanjaan.
